Martello were instructed on behalf of a commodity trading company to provide an expert witness report in a dispute relating to the breach of a Sale and Purchase Agreement (SPA) of Liquefied Natural Gas (LNG). Following the breach of this SPA, our client had to purchase replacement LNG cargoes to maintain its supply to its own clients.
The expert work involved assessing the LNG market at the time in question to calculate the value of said replacement cargoes had they have been purchased on different dates following the breach of the SPA. The expert also compiled two supplemental reports in response to the opposing experts report and supplemental report.
The Martello analysis involved extracting relevant data from globally used sources to support conclusions reached by the expert. The Martello team also assisted in constructing and proof-reading the expert report, multiple supplemental reports, as well as creating appendices demonstrating the data.
