Martello were instructed on behalf of a bank to provide an expert witness report in a dispute relating to the competing claims of defendants for the same product. Our expert was asked to opine on the differences between High Sulphur Fuel Oil and Low Sulphur Fuel Oil and the standard practice for repurchase agreements for such products.

The expert work involved reviewing the features of the trades under the repurchase agreements and providing expertise in relation to the different fuel oil products. The expert also attended an expert meeting and co-authored a joint statement between the numerous experts involved in the case.

The Martello team assisted in constructing and proof-reading the expert report within short notice as well as providing guidance for the expert during the joint statement process. This case team was led by Haley Kleiner.
