Martello were instructed on behalf of a metal trading company to provide an expert witness report in a dispute relating to the breach of a contract for heavy metal scrap (HMS).

The expert work involved providing a general introduction into HMS and the specific market the claim was based in. The expert assessed the valuation of the cargo in the contract and the subsequent sale to a third party after the contract termination. The concept of ‘distressed cargos’ was important to explain to the Tribunal.

Martello extracted and analysed relevant data from recognised sources to assist the expert in reaching their conclusions. The Martello team worked with the expert on structuring and drafting the report and created the accompanying appendices, all in a compressed timeframe of a matter of weeks.
