Martello provided an expert witness report on market pricing of the commodity Palm Olein, in a dispute relating to the market price of Refined Bleached and Deodorised Palm Olein. Our expert was asked to opine on the market price on multiple dates.

The expert work was critical to the damages calculation, and there were various inputs to consider and opine on such as the cost of freight and import costs. The in-house Martello analyst team (led by Rachel Henderson) researched contemporaneous sources under the expert’s supervision. The joint expert meeting focussed on discussing the different assumptions used by each expert. After the expert meeting, the experts’ adjusted their respective calculations, providing a helpful summary of their pricing assumptions in the joint statement and explaining the remaining differences for the Tribunal.

Our expert was then cross-examined at the hearing, and we await the award.
