Martello were instructed on behalf of a solicitor’s partnership to provide an expert witness report relating to the duty of an independent financial adviser (IFA) in a dispute regarding an IFA allegedly neglecting to protect its’ client’s (a high net worth individual (HNWI)) pension contributions.
The expert work involved explaining an introduction to IFAs as well as the progression of pension regulation throughout the 21st century. The Martello analysis involved extracting relevant data from a designated document bundle and providing a chronology of events upon which the expert and legal team relied upon. This analyst team was led by Rachel Henderson. It was imperative that the duty and actions of a typical IFA were explained in a clear and digestible way for the Court, therefore allowing the Martello analyst team to act as a ‘sounding board’ for the expert’s initial views on the topic.
The case achieved settlement before hearing.
